A United Boeing 777-200, registration N781UA performing flight UA-999 from Newark,NJ (USA) to Brussels (Belgium) with 246 people on board, was enroute at FL380 over the Atlantic Ocean about 580nm east of Gander,NL (Canada), when cabin crew noticed fumes in the cabin and informed the flight deck. An examination showed the odour was basically confined to the first class inboard lavatory. The flight crew donned their oxygen masks and initiated a diversion to Gander reporting fumes of unknown origin, Oceanic Air Traffic Control however was unable to provide a clearance due to conflicting traffic. The flight crew declared emergency and initiated the diversion and descent according to oceanic contingency procedures without clearance. After the aircraft had descended to FL300 ATC was able to clear the flight to Gander, where the aircraft landed without further incident about 90 minutes after turning around.

The Canadian TSB reported that maintenance found no evidence of fire, heat or smoke, but identified the trash container in the lavatory as source of the odour.

The occurrence aircraft remained on the ground in Gander for about 5.5 hours, then returned to Newark as flight UA-999.
