A Chautauqua Airlines Embraer ERJ-135, registration N377SK performing flight RP-5021 from La Crosse,WI to Chicago O'Hare,IL (USA) with 36 passengers and 3 crew, was on final approach to O'Hare's runway 09R in contact with North Tower controller, when a Trans States Embraer ERJ-145 on behalf of United Airlines, registration N845HK performing flight AX-3367/UA-3367 from Chicago O'Hare,IL to Moline,IL (USA) with 42 passengers and 3 crew, in contact with Tower 3 controller received takeoff clearance from runway 32L, which intersects with runway 09R. The Tower 3 controller noticed the conflict when the Chautauqua was about 1nm from the landing threshold runway 09R and instructed the North controller to have the Chautauqua go-around. He then notified the Trans States Embraer, which had just lifted off: "traffic alert, left to right it's an American Eagle, stay as low as you can". After the Trans States passed the intersection with runway 09R the crew resumed normal climb and continued to Moline for a safe landing. The Chautauqua was vectored for another approach and a safe landing.

The NTSB reported that the separation between the aircraft reduced to 125 feet vertical and 350 feet horizontally above the extended center line of runway 32L. Cloud ceilings were at 20,000 feet and visibility was above 10 statute miles. An investigation has been initiated.

On Sep 15th 2012 the NTSB released their brief factual report basically repeating the information already reported on Aug 25th 2011.

On Nov 8th 2012 the NTSB released their final report concluding the probable cause was:

The improper air traffic control takeoff clearance issued by the local controller because of his lack of monitoring and lack of awareness of the conflicting arrival airplane.
