An Air Canada Rouge Airbus A319-100, registration C-FYIY performing flight RV-1871 from Orlando,FL (USA) to Montreal,QC (Canada) with 126 people on board, departed Orlando's runway 35L when during departure ADIRU #1 failed. After becoming airborne the gear did not retract and the aircraft reverted to direct law. The crew stopped the climb at about 6000 feet, declared PAN and entered a hold to work the related checklists upgrading their PAN call to Mayday, the aircraft was prepared for an abnormal and overweight landing. The aircraft landed safely back on runway 36L about 40 minutes after departure.

A replacement Boeing 767-300 registration C-FMWV reached Montreal with a delay of 4 hours.

The Canadian TSB reported the A319 had been dispatched under minimum equipment list requirements with ADIRU #3 inoperative. Following the occurrence maintenance replaced the air data module according to aircraft maintenance manual.
