A Swiss Avro RJ-100, registration HB-IYS performing flight LX-1038 from Basel (Switzerland) to Hamburg (Germany), was in the initial climb out of Basel Mulhouse's runway 33 when the crew could not retract the flaps, levelled off at 7000 feet, entered a hold to burn off fuel and returned to Basel/Mulhouse for a safe landing on runway 33 about 50 minutes after departure.

The flight was cancelled.

A passenger reported the captain announced a flaps malfunction, the aircraft subsequently entered a holding to burn off fuel and returned to Basel with emergency services on stand by. Mechanics checked the aircraft for about 20 minutes then the passengers were instructed to disembark. They were offered to stay in hotels over night to catch a flight to Hamburg the next morning.
