MHS D328 at Mannheim on Sep 8th 2018, near collision with private aircraft

A MHS Aviation Dornier Do-328-100, registration D-CIRP performing flight MHV-9241 from Sylt to Mannheim (Germany) with 28 passengers and 3 crew, was on approach to Mannheim being in contact with Mannheim approach on an instrument approach, however, enroute in Class E Airspace, when the crew spotted a private aircraft immediately ahead, performed an immediate left turn to evade a possible collision, the private pilot later reporting he spotted the larger twin aircraft just for a glimpse seeing the underbelly of the aircraft that was in a about 45 degrees left bank. After avoiding the collision the D328 continued for a safe landing at Mannheim, the private aircraft continued to its destination.

On Mar 4th 2019 Germany's BFU released their bulletin reporting according to radar data the near collision occurred at 3200 feet MSL, the separation between the two aircraft reduced to 0 feet vertical and 0.126 nautical miles.

The BFU stated both aircraft were operating in Class E Airspace at that time, where IFR traffic is separated to IFR traffic and traffic information about VFR traffic is provided when possible.

The BFU reported the Do-328 had been vectored for a visual approach under instrument rules to runway 09 at Mannheim. The approach controller assessed the Do-328 would be following a track, in which the private aircraft would pose no factor and thus did not provide information about that traffic to the crew. 17 seconds later the crew however requested an approach to runway 27, the controller denied that clearance. About a minute later the crew reported they were joining the right hand pattern (presumably for runway 09), the controller cleared the flight to join the northern traffic pattern, which the crew read back. About 30 seconds after that clearance the controller advised: "observe ähh unknown traffic, ähh eleven o´clock, range less than a mile, three thousand feet, not confirmed.", the crew did not respond however (and in later interviews stated they had not heard that traffic information). While the controller attempted to get more information about that private aircraft from ATC Langen, the D328 crew spotted the aircraft right in front of them and performed the evasive maneouver.

The D328 crew reported the private aircraft had not been visible on their TCAS display until after the closest point of approximation, then the traffic became visible. No advisory was issued. The BFU reported the transponder of the private aircraft was working at the time, a deeper investigation into why TCAS did not show the aircraft and did not issue an advisory is being conducted.

The BFU reported the private aircraft carried the pilot and a passenger. The weather conditions at the time were visibility beyond 10km, no significant cloud below 5000 feet AGL.
