Enter B738 near Stuttgart on Feb 25th 2016, crew ignored TCAS RA

An Enter Air Boeing 737-800, registration SP-ENX performing flight ENT-511 from Gdansk (Poland) to Jerez,SP (Spain), was enroute at FL370 about 15nm eastnortheast of Stuttgart (Germany), when the crew received a TCAS resolution advisory to climb indicating a conflict with a fast climbing Falcon 2000 business jet climbing out of Memmingen (Germany). The captain made visual contact with the conflicting aircraft, assessed there was no need to perform an avoidance maneouver and therefore did not follow the TCAS resolution advisory, the captain however reported the TCAS RA to ATC.

A Dassault Falcon Service Falcon 2000 had departed Memmingen (Germany), was cleared to climb to FL430 and climbed rapidly, when the crew received a TCAS RA to descend and followed the resolution advisory.

After being clear of conflict both aircraft continued their flights for safe landings at their destinations.

Poland's PKBWL reported the cause of the serious incident was too high a climb rate by the Falcon 2000.

The PKBWL recommended that Enter Air should instruct the 737 Captain about proper use and principles of ACAS and adherence to procedures.

The PKBWL reported that according to Germany's Authorities plotting the radar tracks of both aircraft there was a violation of required minimum separation between the two aircraft.

The PKBWL stated that the investigation learned about the occurrence through the Aviation Safety Reporting System. While checking the records of the operators and collecting testimonies by the crews involved the investigation found deviations from the ACAS (TCAS) procedures by the 737 crew, who had received a CLIMB resolution advisory, the captain however chose to not follow the resolution advisory after establishing visual contact with the conflicting aircraft. The PKBWL stated, that the Captain's assessment was insufficient to verify that the flight safety was not endangered.

The PKBWL stated that the captain made clear in his interview with the PKBWL that he was familiar with the rules and procedures concerning ACAS.
