An Air Transat Airbus A310-300, registration C-GTSK performing flight TS-237 from Dublin (Ireland) to Toronto,ON (Canada) with 347 people on board, was enroute at FL320 over the Atlantic Ocean between 59N020W and 61N030W when the crew declared PAN reporting the failure of both transponders and initiated the North Atlantic contingency procedure because of being no longer compliant with RVSM requirements. Oceanic Control at Prestwick, Reykjavik and Gander established non-RVSM separation with all other aircraft and cleared the flight to climb back to its originally assigned flight level. The aircraft continued to Toronto for a safe landing.

The Canadian TSB reported the aircraft had been dispatched under minimum list requirements with the #1 transponder inoperative. While in Oceanic Airspace the #2 transponder failed prompting the North Atlantic Contingency Procedure. The aircraft was cleared to climb back to FL320 after non-RVSM separation was established with all other aircraft.
