An Air Arabia Maroc Airbus A320-200, registration CN-NMI performing flight 3O-335 from Casablanca (Morocco) to Montpellier (France), was on final approach to Montpellier's runway 12L when the crew decided to go around and turned east.

A private Diamond DA-42 (operated for a flying club in training/instruction) was flying and maneouvering at about 2000 feet east of Monpellier Aerodrome.

The French BEA reported: "CN-NMI was on final for Runway 12L while a commercial transport flight was lining up and taking off on the same runway. The crew of CN-NMI decided to abort the approach. While climbing, CN-NMI closed in on the DA42, which was descending east of the runway centerlines. CN-NMI stabilized at around 2,000 ft, and the pilot of the DA42 accelerated his descent." The occurrence was rated a serious incident involving an abrupt maneouver and an airprox/ACAS warning/Loss of Separation/Collision/Near Collision and is being investigated by the BEA.
