A Porter Airlines de Havilland Dash 8-400, registration C-GLQV performing flight PD-139 from Toronto Billy Bishop,ON (Canada) to Newark,NJ (USA) with 72 people on board, was on approach to Newark when the aircraft was put into a hold at 11,000 feet about 70nm north of Newark due to weather, where the aircraft remained for about 60 minutes. In addition the crew determined that their chosen alternate did not feature customs. Hence the crew decided to return to Toronto Billy Bishop Airport in about 245nm flying distance. Due to concerns of landing during night curfew the crew subsequently decided to divert to Toronto's International Airport and determining that their fuel would fall below minimum fuel requested direct vectors, air traffic control however declined due to volume of traffic. The crew therefore declared emergency due to low fuel and was provided with direct vectors. The aircraft landed safely on runway 24R about 3:12 hours after departure.

The Canadian TSB reported the aircraft landed with 1260lbs (572 kg) of fuel remaining.
