Germany's BFU reported in their monthly bulletin, that according to military radar data the horizontal separation reduced to 0.1nm (600 feet), the glider did not provide a transponder signal, the altitude was not known. According to the Boeing first officer's estimations the glider aircraft was about 100 feet below the Boeing at an estimated altitude of 6400 feet.
The air traffic controller had no target on his radar screen.
The BFU reported that both aircraft were operating in class E airspace permitting both IFR and VFR traffic, where air traffic control would provide separation between IFR aircraft and would provide advisories, but no separation, to VFR traffic. All powered aircraft must carry a working transponder above 5000 feet.
Due to the lack of transponder neither ATC were aware of the glider aircraft nor did the TCAS on board of the Boeing 737 generate (traffic or resolution) advisories.
