An Air Canada Boeing 777-300, registration C-FIUV performing flight AC-869 from London Heathrow,EN (UK) to Toronto,ON (Canada), was enroute at FL340 over the Atlantic Ocean near Position N56W40 when the crew requested to step climb to FL360 via CPDLC. The aircraft was cleared to climb to FL350 via CPDLC (Controller-Pilot-Data-Link-Communications), the message contained the advisory "requested level not available". The crew acknowledged the transmission but climbed to FL360. When the flight level was confirmed the aircraft was instructed to immediately descend to FL350 due to conflicting traffic. The crew descended to FL350 and continued for a safe landing in Toronto.

The Canadian TSB reported that a corporate jet was enroute at FL360 on the same track about 7 minutes behind the Boeing 777-300, the required separation was 8 minutes however, a loss of separation therefore occurred.
